\n 20.5.1 Access to Specific Information and Data Portability\n Rights: You may have the right to request that FireUp disclose\n certain information to you about our collection and use of your\n consumer information over the past 12 months. Once we receive\n and confirm your verifiable consumer request (in the manner\n described in Section 20.6 below), to the extent required by the\n CCPA, we will disclose to you:\n

\n 20.5.2 Deletion Request Rights: You have the right to request\n that FireUp delete any of your consumer information that we\n collected from you and retained, subject to certain exceptions.\n Once we receive and confirm a verifiable request from you (if\n you are a California resident) in the manner described in\n Section 20.6 below (“verifiable consumer request”), we will\n delete (and direct our service providers to delete) your\n consumer information from our records, unless an exception\n applies. We may deny your deletion request if retaining the\n information is necessary for us or our service provider(s) to:\n

\n - \n \n 20.5.2.1 Complete the transaction for which we collected the\n consumer information, provide a product or service that you\n requested, take actions reasonably anticipated within the\n context of our ongoing business relationship with you, fulfill\n the terms of a written warranty or product recall conducted in\n accordance with federal law, or otherwise perform our contract\n with you.\n
\n - \n \n 20.5.2.2 Detect security incidents, protect against malicious,\n deceptive, fraudulent, or illegal activity, or prosecute those\n responsible for such activities.\n
\n - \n \n 20.5.2.3 Debug products or services to identify and repair\n errors that impair existing intended functionality.\n
\n - \n \n 20.5.2.4 Exercise free speech, ensure the right of another\n consumer to exercise their free speech rights, or exercise\n another right provided for by law.\n
\n - \n \n 20.5.2.5 Comply with the California Electronic Communications\n Privacy Act (Cal. Penal Code § 1546 et. seq.).\n
\n - \n \n 20.5.2.6 Engage in public or peer-reviewed scientific,\n historical, or statistical research in the public interest\n that adheres to all other applicable ethics and privacy laws,\n when the information's deletion may likely render impossible\n or seriously impair the research's achievement, if you\n previously provided informed consent.\n
\n - \n \n 20.5.2.7 Enable solely internal uses that are reasonably\n aligned with consumer expectations based on your relationship\n with us.\n
\n - \n \n 20.5.2.8 Comply with a legal obligation.\n
\n - \n \n 20.5.2.9 Make other internal and lawful uses of that\n information that are compatible with the context in which you\n provided it.\n

\n 20.6 Exercising Access, Data Portability, and Deletion Rights.\n
\n
\n - \n \n 20.6.1 To exercise the access, data portability, and deletion\n rights described in Section 20.5 above, please submit a\n verifiable consumer request to us by either: (1) calling us at\n +1(855)-FireUp; (2) visiting\n https://www.FireUp.com/data-opt-out; or (3) contacting us in\n accordance with Section 21. Only you, someone legally\n authorized to act on your behalf, (such as an authorized\n agent) may make a verifiable consumer request related to your\n consumer information. You may also make a verifiable consumer\n request on behalf of your minor child. You may make a\n verifiable consumer request for access or data portability no\n more than twice within a 12-month period. The verifiable\n consumer request must: (i) provide sufficient information that\n allows us to reasonably verify you are the person about whom\n we collected consumer information or an authorized\n representative; and (ii) describe your request with sufficient\n detail that allows us to properly understand, evaluate, and\n respond to it. We cannot respond to your request or provide\n you with consumer information if we cannot verify your\n identity or authority to make the request and confirm the\n consumer information relates to you. Making a verifiable\n consumer request does not require you to create an account\n with us. We will only use consumer information provided in a\n verifiable consumer request to verify the requestor's identity\n or authority to make the request. In the event you make a\n request under this paragraph, we may take various approaches\n to verify your identity depending on the nature of your\n request. These approaches may include asking you questions\n pertaining to the information we have about you.\n
\n - \n \n 20.6.2 We endeavour to respond to a verifiable consumer\n request within forty-five (45) days of its receipt. If we\n require more time (up to ninety (90) days), we will inform you\n of the reason and extension period in writing. If you have an\n account with us, we may deliver our written response to that\n account. If you do not have an account with us, we will\n deliver our written response by mail or electronically, at\n your option. Any disclosures we provide will only cover the\n 12-month period preceding the verifiable consumer request's\n receipt. The response we provide will also explain the reasons\n we cannot comply with a request, if applicable. For data\n portability requests, we will select a format to provide your\n consumer information that is readily useable and should allow\n you to transmit the information from one entity to another\n entity without hindrance. If your requests are manifestly\n unfounded or excessive, in particular because of their\n repetitive character, we may either charge a reasonable fee,\n taking into account the administrative costs of providing the\n information or communication or taking the action requested,\n or refuse to act on the request and notify you of the reason\n for refusing the request.\n

\n 20.7 Non-Discrimination: We will not discriminate against you\n for exercising any of your CCPA rights, including, unless\n permitted by the CCPA, by:\n

22. ADDITIONAL PROVISIONS FOR TRANSFER DATA

\n 22.1 Privacy Shield Framework. As noted above, FireUp, Inc.\n complies with the EU-U.S. Privacy Shield Framework and the\n Swiss-U.S. Privacy Shield Framework as set forth by the U.S.\n Department of Commerce regarding the collection, use, and\n retention of transfer data.\n

\n 22.2 Types of Transfer Data Collected: The types of transfer\n data that may be collected by FireUp, Inc. are the types of\n Personal Data described under Sections 3 and 4 above.\n Additionally, Processed Transfer Data includes information\n relating to social media influencers whose Personal Data is\n entered into FireUp, Inc.'s business customer's Platform\n account by such business customer, excluding that certain\n publicly available influencer data for which FireUp, Inc. is\n the controller and which is subject to FireUp's Influencer\n Privacy Notice.\n

\n 22.3 Purpose for Which Transfer Data is Collected and Used: The\n purposes for which transfer data is collected and used by\n FireUp, Inc. are those purposes described under Sections 5 and\n 6 above. FireUp, Inc. collects and uses Processed Transfer Data\n only on the instructions of the applicable third-party\n controller.\n

\n 22.4 Types of Third Parties to which Transfer Data is Disclosed:\n Transfer data is disclosed with the same types of third parties\n and for the same purposes as are described under Section 7\n above.\n

\n 22.5 Access: Your rights to access your transfer data processed\n by us are described in Section 12 above. With respect to\n Processed Transfer Data, FireUp, Inc. will work with the\n applicable third-party controller to facilitate any right of\n access as described in Section 12.\n

\n 22.6 Onward Transfer: Before we disclose any of your transfer\n data to a third party we will require that such third party\n provide the same level of privacy protection as is required by\n the Privacy Shield Principles. FireUp, Inc.’s accountability\n for transfer data that it receives under the Privacy Shield and\n transfers to a third party is outlined in the Privacy Shield\n Principles. In particular, FireUp, Inc. remains liable under\n the Privacy Shield Principles if third-party agents that it\n retains to process transfer data on FireUp, Inc.’s behalf\n process such transfer data in a manner inconsistent with the\n Privacy Shield Principles, unless FireUp, Inc. can prove that\n it is not responsible for the event giving rise to the damage.\n

\n 22.7 Choice: If you no longer wish to have your transfer data\n disclosed to third parties, you may choose to \"opt out\" by\n notifying us. To do so, send an email to\n datarequest@FireUp.com. Please be aware that your transfer data\n may have been previously disclosed to third parties in\n accordance with the terms of this privacy notice. Further, with\n respect to Processed Transfer Data, FireUp, Inc. will work with\n the applicable third-party controller to facilitate such choice.\n Also, FireUp, Inc. will provide you with notice before using\n your transfer data for a purpose other than that for which it\n was originally collected or subsequently authorized by you, and\n you may choose to “opt out” of such use by following the\n directions provided in the notice. However, even after any\n “opt-out”, your transfer data may be used and disclosed to a\n third party upon a good faith belief that such disclosure is\n required in order to comply with an applicable statute,\n regulation, rule or law, a subpoena, a search warrant, a court\n or regulatory order, lawful requests by public authorities,\n including to meet national security or law enforcement\n requirements, or other valid legal process. Without limitation\n of any other provision contained herein, following your “opt\n out”, your information that already has been gathered may\n continue to be used and to be disclosed to third parties,\n provided that such information will be anonymized in order to\n ensure that you cannot be identified anymore.\n

\n 22.8 Data Integrity and Purpose Limitation: Except as may be\n authorized by you, we use your transfer data in a manner that is\n compatible with and relevant for the purpose for which it was\n collected. To the extent necessary for these purposes, we take\n reasonable steps to ensure that transfer data is accurate,\n complete, current, and reliable for its intended use. With\n respect to Processed Transfer Data, FireUp, Inc.'s obligations\n under this Section 22.8 may be limited to working with the\n applicable third-party controller, given FireUp, Inc.'s role as\n a processor.\n

\n 22.9 Recourse, Enforcement and Liability: FireUp, Inc. uses the\n self-assessment method to verify the attestations and assertions\n made herein and to ensure that its privacy practices have been\n implemented as presented herein. Any questions, complaints, or\n concerns regarding this privacy notice should be directed to\n FireUp, Inc. in accordance with Section 21 above. FireUp, Inc.\n will investigate and attempt to resolve any disputes/complaints,\n including correcting any transfer data, using transfer data\n consistent with the Privacy Shield Principles, reversing or\n correcting the effects of noncompliance, and assuring that\n future processing of transfer data will be in conformity with\n the Privacy Shield Principles. For any complaints regarding\n transfer data that cannot be resolved by FireUp, Inc. directly,\n FireUp, Inc. commits to cooperate with the panel established by\n the EU Data Protection Authorities (“DPAs”) and the Swiss\n Federal Data Protection and Information Commissioner\n (“Commissioner”), as applicable, to investigate unresolved\n disputes/complaints and comply with the advice given by the\n panel and/or Commissioner. With respect to the application of\n Privacy Shield Principles to transfer data, the panel\n established by the DPAs and/or the Commissioner, as applicable,\n is the independent dispute resolution body designed to address\n complaints and provide appropriate recourse to you free of\n charge. As further described in the Privacy Shield Principles, a\n binding arbitration option will be made available to you in\n order to address residual complaints regarding transfer data\n that have not been resolved by other means. See Section C of\n Annex I to the Privacy Shield Principles at\n https://www.privacyshield.gov/article?id=C-Pre-Arbitration-Requirements\n and\n http://trade.gov/td/services/odsi/swiss-us-privacyshield-framework.pdf.\n The Federal Trade Commission has jurisdiction over FireUp,\n Inc.’s compliance with the Privacy Shield. Adherence by FireUp,\n Inc. to the Privacy Shield Principles and the above-set forth\n provisions regarding transfer data may be limited (a) to the\n extent necessary to meet national security, public interest or\n law enforcement requirements; (b) by statute, government\n regulation, or case law that creates conflicting obligations or\n explicit authorizations; or (c) if the effect of the GDPR or\n Member State law is to allow exceptions or derogations, provided\n that such exceptions or derogations are applied in comparable\n contexts.\n
